Terms of Service Agreement

1.We do not warrant or guarantee that the domain name applied for will be registered in your name or is capable of being registered by you. Accordingly, you should take no action in respect of your requested domain name(s) until you have been notified that your requested domain name has been registered.

2.The registration of the domain name and its ongoing use is subject to the relevant naming authority's terms and conditions of use and you are responsible for ensuring that you are aware of those terms and conditions and can and do comply with them. You irrevocably waive any claims you may have against us in respect of the decision of a naming authority to refuse to register a domain name and, without limitation agree that the administration charge paid by you to us shall be non-refundable in any event.

3.We accept no responsibility in respect of the use of a domain name by you and any dispute between you and any other individual or organisation regarding a domain name must be resolved between the parties concerned and we will take no part in any such dispute. We reserve the right, on our becoming aware of such a dispute, at our sole discretion and without giving any reason, to either suspend or cancel the domain name, and/or to make appropriate representations to the relevant naming authority.

4. We shall not release any domain to another provider unless full payment for that domain has been received by us.

5. Payment for domain names are to be met within 7 days of request for registration, if payment is not met 7 days the account details will be passed to a Debt Collection Agency, who will be instructed to take all means necessary to recover monies owed. If this action is taken, an administration charge of £50.00 will be added in addition to all and any costs imposed by the Debt Collector.

6. Upon receipt of an order, a domain name is registered AND PAID FOR instantly by MagnaCom Limited, therefore making the order non-cancellable. No communication will be entered into regarding this matter - once an order has been placed, it is a binding contract and cannot be withdrawn except where refusal by the naming authority to register your desired name has transpired.


Using MagnaCom's Hosting Service constitutes acceptance of the following terms and conditions.

1. This Service is provided on an as is, as available service. MagnaCom Limited makes no warranties of any kind, either expressed or implied.

2. Under no circumstances, including negligence, shall MagnaCom Limited, or anyone else involved in creating, producing or distributing this Service, be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use this Service including, but not limited to, reliance on any information obtained through this Service; or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to MagnaCom Limited's records, programs or services.

3. This Service may only be used for lawful purposes. Transmission of any material in violation of any UK law is prohibited. This includes but is not limited to material in the opinion of MagnaCom Limited to be threatening, obscene, or pornographic, or any material copywritten or trademarked in any form.

4. MagnaCom Limited reserves the right at its sole discretion to review, edit, or refuse to post any material or information. Notwithstanding the foregoing, MagnaCom Limited will not intentionally monitor or disclose any private E-mail message unless permitted or required by law. MagnaCom Limited reserves the right to remove any content that it deems in its sole discretion to be unacceptable or undesirable.

5. The following actions may result in the immediate termination of your Service account without recourse and should NOT be done:
(a) sending unsolicited email messages that contain ANY email or web addresses from your account to online users,
(b) posting messages that contain your Service addresses in Usenet Newsgroups that are unrelated to your product or service
(c) forging your "From" Address in an email message, or newsgroup posting, with your Service addresses - giving the impression that the message or posting originated from the MagnaCom Limited Network.

6. Either you or MagnaCom Limited may terminate your account at any time. Your only right with respect to any dissatisfaction with any terms, rules, policies, guidelines, or practices of MagnaCom Limited in operating this Service, any change in the contents of this Service, or any change in the amount or type of fees charged in connection with this Service, is to terminate your account by delivering notice to MagnaCom Limited, effective the day MagnaCom Limited receives notification of termination or any future date specified which is acceptable to MagnaCom Limited. MagnaCom Limited may terminate immediately any customer who misuses or fails to abide by this Agreement. MagnaCom Limited may terminate without notice your access to and use of this Service upon a breach of this Agreement.

7. On Termination of an Account, outstanding fees to be met within 7 days of request for termination. All our Accounts are Annual even though they may be paid Quarterly. If payment is not met within 7 days the account details will be passed to a Debt Collection Agency, who will be instructed to take all means necessary to recover monies owed. If this action is taken, an administration charge of £50.00 will be added in addition to all and any costs imposed by the Debt Collector.
